General Terms and Conditions – Bed & Breakfast 'De Lagune'

1. Definitions

1.1 B&B: VOF Stal Cartier, trading as 'B&B De -Lagune' and Chamber of Commerce number 75502666, located at Lagunesingel 15, 6642ER Beuningen.

1.2 Guest: The natural person who makes a reservation and/or stays at the B&B.

1.3 Agreement: The agreement to rent a room or accommodation unit.

1.4 Parties: The B&B and the guest jointly.

2. Applicability

2.1 These conditions apply to all reservations, agreements and services of the B&B.

2.2 Deviations only apply if agreed in writing.

3. Reservation and confirmation

3.1 A reservation is binding after written or electronic confirmation by the B&B.

3.2 When making a reservation, correct personal data must be provided.

3.3 The B&B reserves the right to refuse reservations if there is suspicion of misuse or non-payment.

4. Prices and payment

4.1 All prices include VAT and exclude tourist tax and mandatory final cleaning, unless stated otherwise.

4.2 Prices are based on the rates applicable at the time of booking confirmation. If statutory levies or VAT rates change after booking, the B&B reserves the right to pass these on to the guest.

4.3 When booking, a deposit of up to 100% of the total amount may be requested, depending on the date of stay, duration of stay and/or number of rooms reserved.

4.4 The remaining amount must be credited to the B&B account no later than 6 weeks before the arrival date, unless otherwise agreed in writing.

4.5 For reservations made within 6 weeks of the arrival date, the full amount must be paid immediately upon reservation.

4.6 Any additional costs for services or products used by the guest during the stay must be paid in cash or by direct electronic payment upon departure.

4.7 If the guest does not pay on time, the B&B reserves the right to cancel the reservation. In that case, the cancellation policy applies, and the guest is liable for any cancellation fees.

5. Cancellation by guest

5.1 Cancellations must be communicated in writing or by email.

5.2 If cancellation is made more than 6 weeks before the arrival date, a refund will be made, except for an administration fee of €50.

5.3 In case of cancellation from 6 weeks before the arrival date up to the arrival date and in case of no-show, the guest is liable for the full reservation amount and no refund will be made.

5.4 The guest is advised to take out cancellation insurance to cover any cancellation costs.

5.5 The B&B reserves the right to make a partial refund in exceptional cases, and after submitting relevant supporting documents, but is not obliged to do so.

6. Cancellation by B&B

6.1 The B&B may cancel the reservation in the event of force majeure or other exceptional circumstances.

6.2 In that case, the amount already paid will be fully refunded, without further liability for additional damages.

7. Damage and liability

7.1 The guest is liable for all damage to the accommodation and inventory caused by himself, fellow guests or visitors.

7.2 Damage must be reported immediately; repair or replacement will be at the guest's expense.

7.3 The guest is liable for loss of keys; replacement costs will be charged.

7.4 The guest is advised to take out his/her own travel and/or liability insurance to cover any damage and/or liability.

7.5 The B&B is not liable for:

a. Theft, loss or damage of guest's property;

b. Injury to the guest unless caused intentionally or through gross negligence on the part of the B&B;

c. Nuisance from outside.

7.6 The guest indemnifies the B&B against claims from third parties for damage caused by the guest.

8. Force Majeure

8.1 In the event of force majeure, the B&B is not obliged to fulfil any obligation.

8.2 Force majeure includes: extreme weather conditions, government measures, pandemics, strikes, utility disruptions, fire and other events beyond the B&B's control.

9. Complaints

9.1 Complaints must be reported during the stay so that the B&B can provide a solution.

9.2 If the complaint is not resolved satisfactorily, it can be submitted in writing within 14 days after departure.

10. Applicable law

10.1 These terms and conditions and all agreements are exclusively governed by Dutch law.

10.2 Disputes will be submitted to the competent court in the district where the B&B is established.
